Legislative news in February 2014

LEGISLATIVE NEWS IN FEBRUARY 2014

During February 2014 a series of normative acts relevant to the business environment in Romania were published in the Official Gazette of Romania, Part I.

Among these are the following:

1. Order no. 12/2014 of the National Authority for Regulation in the Field of Energy, regarding the establishment of the mandatory share for acquiring green certificates, afferent to the year 2013 was published in The Official Gazette of Romania no. 145 from the 27th of February 2014.

The act came into force on the 27th of February 2014.

The act contains the mandatory share for acquiring green certificates by business operators who have the obligation to acquire green certificates, for the year 2013, respectively 0.224 green certificates/MWh.

2. Government Decision no. 77/2014 for modifying and completing the Methodological Norms for the application of Law no. 571/2003 regarding the Fiscal Code, approved through Government Decision no. 44/2004 was published in the Official Gazette of Romania, Part I, no. 108 from the 12th of February 2014.

The act came into force on the 12th of February 2014.

The Decision contains the modifications brought to the Methodological Norms for the application of Law no. 571/2003 regarding the Fiscal Code, approved through Government Decision no. 44/2004, published in the Official Gazette of Romania, Part I on the 6th of February 2004.

3. Order no. 117/2014 of the President of the National Agency of Fiscal Administration for approving the form “Tax decision regarding the anticipated payments of social security contributions for health, for the incomes resulting from the concession of assets” was published in The Official Gazette of Romania, Part I, no. 103 from the 11th of February 2014.

The act came into force on the 11th of February 2014.

The act approves the model and content of the form “Tax decision regarding the anticipated payments of social security contributions for health, for the incomes resulting from the concession of assets” (650), code 14.13.02.15/cfb, as well as the annex “Report regarding the determination of the monthly contribution for health social security.”

4. Law no. 286/2009 regarding the Criminal Code was published in The Official Gazette of Romania, Part I, no. 510, from the 24th of July 2009.

The act came into force on the 1st of February 2014.

This act contains the juridical norms through which the criminal acts that constitute felonies, the applicable penalties and the State’s right to call to account the persons who commit felonies are established, in order to defend the law order, applicable beginning on the 1st of February 2014.

5. Law no. 187/2012 for the implementation of Law no. 286/2009 regarding the Criminal Code was published in The Official Gazette of Romania, Part I, no. 757, from the 12th of November 2012.

The act came into force on the 1st of February 2014.

This law contains the provisions for implementing the Criminal Code, as subsequently amended and republished, its primary purpose being the harmonization of the existent criminal legislation with its provisions, as well as establishing the rules for solving the conflict of laws resulting from the enforcement of the Criminal Code.

6. Law no. 135/2010 regarding the Criminal Procedure Code was published in The Official Gazette of Romania, Part I, no. 486 from the 15th of July 2010.

The act came into force on the 1st of February 2014.

This act contains the criminal procedure norms that regulate the ongoing of the criminal trial, as well as that of other judiciary proceedings regarding a criminal case.

7. Law no. 255/2013 for the implementation of Law no. 135/2010 regarding the Criminal Procedure Code and for modifying and completing certain acts that contain criminal procedural provisions was published in The Official Gazette of Romania, Part I, no. 515 from August 14th 2013.

The act came into force on the 1st of February 2014.

This law contains the provisions regarding the implementation of the New Criminal Procedure Code, by regulating the transitory situations resulting from its enforcement, as well as the harmonization of the criminal legislation with its provisions.
